Apparently the U.S. government can now invoke provisions to keep secret programs from being dubbed illegal. The Electronic Frontier Foundation (EFF) has filed a lawsuit against AT&T for its role in domestic spying on innocent Americans, but the government claimed it could use a provision knows as the “state secrets prilvage” that basically states that even if the Supreme Court finds a program unlawful, it would be powerless to rule against it because the program is a secret. To rule against such a program would acknowledge its existence.

The “state secrets privilege” is a privilege actually created by the courts 50 years ago. Its purpose is to shield the government from revealing information in court which could damage the country’s security. Because it is such a potent tool, the Federation of American Scientists dubs it “the nuclear bomb of legal tactics,” and when the government uses it, it almost always wins. Case dismissed.

When are these tactics going to stop?  There is no limit to the lengths that the government will go to protect itself from being proven wrong about these domestic spying programs.  Every day our government is taking a little bit of your rights away.  Before too long, no one will have a say in the process of government because there won’t be a way to trump its power over every U.S. citizen.
